Welcome to The Passive House Way. These Terms of Service (“Terms”) govern your access to and use of our website (https://thepassivehouseway.com) and any consulting services provided by The Passive House Way (ABN 70 509 964 033).

1. Acceptance of Terms

By accessing our website or engaging our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our site or services.

2. Services

The Passive House Way provides Passive House consulting services, including but not limited to:

Energy modelling and performance analysis
Airtightness testing and certification
Design review and optimisation
On-site inspections and quality assurance

All service details and deliverables will be confirmed in a separate Service Agreement or engagement letter.

3. User Conduct and Content

You agree not to upload or transmit any material that is unlawful, defamatory, or infringes third-party rights.
You may not use our site to distribute spam or malware.
You are responsible for maintaining the confidentiality of any login credentials.

4. Intellectual Property

All content on this site (text, images, logos, manuals) is the property of The Passive House Way or its licensors and is protected by copyright and other intellectual property laws. You may view and download material for personal, non-commercial use only. Redistribution or modification without permission is prohibited.

5. Fees and Payment

Fees for consulting services will be outlined in your Service Agreement.
Payments are due within 14 days of invoice unless otherwise agreed.
Late payments may incur a 2% monthly interest fee.
Refunds are at the discretion of The Passive House Way and must be requested within 7 days of invoice date.

6. Disclaimers and Limitation of Liability

Our advice is based on professional standards; however, actual project outcomes may vary due to factors outside our control.
The Passive House Way makes no warranties, express or implied, regarding the accuracy or reliability of site content.
To the maximum extent permitted by law, The Passive House Way’s liability for any claim is limited to the amount you have paid for the relevant services.

7. Governing Law and Dispute Resolution

These Terms and any disputes arising will be governed by the laws of Victoria, Australia. Parties agree to attempt resolution through mediation before pursuing legal action in the courts of Victoria.

8. Changes to Terms

We reserve the right to modify these Terms at any time. The “Last updated” date will reflect changes. Continued use of our site or services constitutes acceptance of updated Terms.
